There are a number of required federal and state labor posters employers must post to comply with various Acts and Executive Orders. This guide is a general list of required posters that will apply to most businesses depending on federal contractor status, employer size, and industry.The Department of Labor has created an interactive tool to help businesses determine what posters they are required to display; access the tool here.
All employers should post the following posters:
- Employee Rights Under the Fair Labor Standards Act
- Job Safety and Health: It’s the Law
- Employee Rights and Responsibilities Under the Family Medical Leave Act (50+ employees)
- Equal Employment Opportunity is the Law
- Employee Polygraph Protection Act
- Your Rights Under USERRA
Federal contractors and subcontractors should post the following:
- Pay Transparency Nondiscrimination Provision
- Notice to All Employees Working on Federal of Federally Financed Construction Projects
- Employee Rights on Government Contracts
- Notification of Employee Rights Under Federal Labor Laws
Employers of migrant or seasonal agricultural employees should post the following:
- Employee Rights under the H-2A Program
- Migrant and Seasonal Agricultural Workers Protection Act
Employers of those with disabilities who are paid a special minimum wage should post the following:
- Employee Rights for Workers with Disabilities Paid at Special Minimum Wages
Your state of business may have further requirements. The State of New York requires that employers post the following notices in a prominent location:
- Criminal Convictions Records
- Discrimination
- Attention Employees Minimum Wage Information
- Deductions from Wages (LS 605)
- Tip Appropriation (LS 204)
- Safety & Health
- Public Work/Prevailing Wage Rates (employers who have a public work project)
- Public Work Project (employers who have a public work project)
- Construction Industry Fair Play Act (employers in the construction industry)
- Notice to Employees (regarding Unemployment Insurance)
- No-smoking signs
- Notice of Compliance (White) for Workers’ Compensation
- Notice of Compliance (Blue) for Disability Benefits
- Form PFL-120 (provided by your insurance carrier when PFL is purchased)
