Understand Household Employment Laws

Household employers must pay nannies and household workers according to federal, state, and local regulations:

  • Minimum Wage: The federal minimum wage rate is $7.25/hour. However, many states and cities have higher rates that would apply when employing a household worker. Check minimum wage rates.
  • Workers’ Compensation: You may be required to have workers’ compensation insurance when you have an employee working in your home. GTM can help you obtain and manage a policy. Check workers’ compensation requirements.
  • Overtime Rules: Federal law entitles nannies and other household employees to an overtime pay rate of at least 1.5 times their regular hourly wage for all overtime worked, if they work over 40 hours in a week. Overtime pay may not be required for live-in employees.
