Household Employment Laws in Your State

Here are some current laws in Massachusetts regarding employment of household workers:

  • Minimum Wage: the current minimum wage is $13.50/hour.
  • Workers’ Compensation: household employers are required to have workers’ compensation insurance. Contact GTM at (800) 929-9213 for a quote.
  • Overtime Rules: hourly employees are entitled to a special overtime pay rate of at least 1.5 times their regular hourly wage for all overtime worked, if they work over 40 hours in a week.
  • Domestic Workers’ Bill of Rights: au pairs are now covered by the Massachusetts Domestic Workers’ Bill of Rights. These protections include meal and rest periods, written agreements, anti-discrimination and harassment protections, notice of termination or severance pay for live-in workers, and access to parental leave for all domestic workers, among other provisions. If your au pair is considered a J-1 Resident Alien, GTM will withhold and remit Social Security and Medicare taxes as well as your federal unemployment taxes. Withholding federal income tax is not mandatory but is available. At year-end, we can provide Form W-2 for your employee and Schedule H for your personal tax return.
