3. ELIGIBILITY

The GTM Client Referral Sweepstakes is open to legal residents of the 50 United States (including the District of Columbia), who are 21 years or older at the time of entry. Employees, officers, and directors of GTM Payroll Services, Inc. (“Sponsor”), its affiliates, subsidiaries, advertising, and promotion agencies, and their immediate family members and/or those living in the same household of each are not eligible to participate. Void where prohibited by law.

4. SWEEPSTAKES PERIOD

The Sweepstakes begins at 12:00 AM EDT on July 1, 2024 and ends at 11:59 PM EDT on September 30, 2024 (“Sweepstakes Period”).

5. PARTICIPATION

Participation in the Contest constitutes Entrant’s full and unconditional agreement to be bound by the terms set forth herein (the “Official Rules”) and by GTM Payroll Services, Inc. decisions, which are final and binding in all matters related to this Contest. These Official Rules supplement any terms and conditions set forth in any email received or social media post. Information about how to enter and Prize form part of the Official Rules. By submitting an Entry (as defined below), each Entrant agrees to the Official Rules and warrants that his or her entry complies with all requirements set out in the Official Rules.

6. HOW TO ENTER

No purchase necessary. During the Sweepstakes Period, to enter the Contest, submit your referral via the Customer Referral form on the GTM’s website. Referrals submitted must be for new GTM clients who are not already in negotiations with GTM for service. Each valid referral will constitute one entry into the Sweepstakes. By participating in the Contest, you represent and warrant that the information that you have submitted or will submit to GTM Payroll Services, Inc. in connection with the Contest is true, correct, and complete in all material respects and is not misleading.
GTM Payroll Services, Inc. is not responsible for lost, late, illegible, stolen, incomplete, invalid, unintelligible, or garbled entries, which may be disqualified in Sponsor’s sole discretion.

7. PRIZE

One (1) winner will receive an American Express gift card valued at $1,000. The prize is non-transferable and no cash alternative is available.

8. ODDS OF WINNING

Odds of winning depend on the number of eligible entries received during the Sweepstakes Period.

9. WINNER SELECTION AND NOTIFICATION

The potential winner will be selected in a random drawing conducted during the first week of October 2024, from all eligible entries received. All Entries must be received before the end of the Contest Period. The potential winner will be notified via email and/or phone within 3 days of the drawing. If a potential winner cannot be contacted, fails to respond within 7 days, or the prize is returned as undeliverable, the potential winner forfeits the prize. An alternate winner will be selected from the remaining eligible entries.

10. PUBLICITY

By participating, entrants agree that GTM Payroll Services, Inc. and its agents and designees may use the winner’s name, likeness, and/or prize information for advertising, publicity, and promotional purposes without further compensation, permission, or notification, except where prohibited by law.

11. TAXES

An IRS Form 1099 reporting the value of the Prize as earned income will be issued to winners. All federal, state, and local taxes, fees, and surcharges on prize are the sole responsibility of the prize winner.

12. GENERAL CONDITIONS

GTM Payroll Services, Inc. reserves the right to cancel, suspend, and/or modify the Sweepstakes if any fraud, technical failures, human error, or any other factor impairs the integrity or proper conduct of this contest.

13. PERSONAL INFORMATION

Personal information collected from Entrants in connection with this Contest is subject to Sponsor’s privacy policy, available at https://gtm.com/privacy/. Entrants agree that any personal information may be processed, shared, and otherwise used for the purposes and within the context of the Contest and any other purposes outlined in these Official Rules. Such personal information may also be used by Sponsor in order to verify any Entrant’s identity, postal address, and telephone number, and to otherwise verify any Entrant’s eligibility to participate in the Contest. Entrants agree that Sponsor may send Entrants various promotional materials, including but not limited to blogs, articles, specials, and informational emails regarding Sponsor’s business activities. Entrants may access, review, rectify, or cancel any personal information held by Sponsor, and/or elect to have an individual’s name excluded from all lists used by Sponsor, by writing to: Customer Referral Program, GTM Payroll Services, Inc., 9 Executive Park Drive, Clifton Park, NY, 12065 or emailing [email protected].

14. DISPUTE GOVERNING LAW

These Official Rules will be governed by the laws of the State of New York, without regard to its conflict of laws provisions. By participating in the Contest, each Entrant consents to the exclusive jurisdiction of the state and federal courts serving Saratoga County, New York; and agrees to waive any objection to such jurisdiction and venue. To the extent permitted by law, the right to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with the Contest are hereby excluded and each Entrant expressly waives any such rights.
