These workers include nannies, housekeepers, drivers, personal assistants, and more.<\/p>\n<p>On Nov. 29, 2010, <a href=\"https:\/\/labor.ny.gov\/legal\/domestic-workers-bill-of-rights.shtm\" target=\"_blank\" rel=\"noopener noreferrer\">New York State<\/a> became the first state in the nation to extend workers\u2019 rights and protections to people working in the household help industry, mandating that domestic workers be:<\/p>\n<ul>\n<li>paid time and a half over their basic hourly rate when they work more than 40 hours per week. (Live-in household help working more than 44 hours per week are entitled to overtime.);<\/li>\n<li>provided one day off for every seven days worked, or overtime pay if the workers agree to work on their day of rest;<\/li>\n<li>paid at least three rest days each year after working for the same employer for one year;<\/li>\n<li>paid weekly; and,<\/li>\n<li>protected against harassment under the New York State Human Rights Law.<\/li>\n<\/ul>\n<p><a title=\"California Domestic Workers Rights Law is in Effect\" href=\"https:\/\/gtm.com\/household\/california-domestic-workers-rights-law-effect\/\" target=\"_blank\" rel=\"noopener noreferrer\">California<\/a>, <a href=\"http:\/\/thinkprogress.org\/economy\/2015\/06\/10\/3667801\/domestic-workers-oregon-connecticut\/\" target=\"_blank\" rel=\"noopener noreferrer\">Connecticut<\/a>, <a href=\"http:\/\/labor.hawaii.gov\/domestic-workers-rights\/\" target=\"_blank\" rel=\"noopener noreferrer\">Hawaii<\/a>, <a title=\"Massachusetts Domestic Workers Bill of Rights Begins April 1st\" href=\"https:\/\/gtm.com\/household\/massachusetts-domestic-workers-bill-of-rights\/\" target=\"_blank\" rel=\"noopener noreferrer\">Massachusetts<\/a>, and <a title=\"Oregon Domestic Workers\u2019 Bill of Rights Signed Into Law\" href=\"https:\/\/gtm.com\/household\/oregon-domestic-workers-bill-of-rights\/\" target=\"_blank\" rel=\"noopener noreferrer\">Oregon<\/a> now have similar Domestic Workers\u2019 Bill of Rights laws, and other states, including Illinois, Ohio, and Texas, are working to offer comparable protections.<\/p>\n<h2>Why did these laws come about?<\/h2>\n<p>Employers\u2014from household employers to large corporations\u2014regularly fail to pay overtime or fail to pay for all hours worked. Termed \u201c<a href=\"http:\/\/www.epi.org\/blog\/wage-theft-by-employers-is-costing-u-s-workers-billions-of-dollars-a-year\/\" target=\"_blank\" rel=\"noopener noreferrer\">wage theft<\/a>,\u201d this practice amounts to an estimated $105 billion per year in stolen wages, according to the national report <a href=\"http:\/\/www.domesticworkers.org\/homeeconomics\/\" target=\"_blank\" rel=\"noopener noreferrer\">Home Economics: The Invisible &amp; Unregulated World of a Domestic Worker<\/a>. This report, issued by the National Domestic Workers Alliance, the Center for Urban Economic Development at the University of Illinois at Chicago, and DataCenter, found:<\/p>\n<ul>\n<li>$10\/hour is the median hourly wage for the domestic workers surveyed;<\/li>\n<li>nearly a quarter (23 percent) of survey respondents are paid less than their state\u2019s minimum wage;<\/li>\n<li>slightly more than half (56 percent) of the survey respondents worked more than 40 hours per week for their primary employer;<\/li>\n<li>many domestic workers are paid a flat rate that does not fluctuate based on hours worked;<\/li>\n<li>widespread substandard working conditions, which go unreported largely due to domestic workers\u2019 isolation in the workplaces; and,<\/li>\n<li>domestic work, though conducted in private homes, contributes substantially to the public good. Household labor is a linchpin connecting the economics of the home and the workplace.<\/li>\n<\/ul>\n<p>GTM continuously monitors labor laws affecting household employment.
