{"id":5455,"date":"2015-02-05T10:13:06","date_gmt":"2015-02-05T15:13:06","guid":{"rendered":"http:\/\/gtm.com\/household\/?p=5455"},"modified":"2017-08-08T09:02:03","modified_gmt":"2017-08-08T13:02:03","slug":"workers-compensation-penalties","status":"publish","type":"post","link":"https:\/\/gtm.com\/household\/workers-compensation-penalties\/","title":{"rendered":"Case Study: Workers&#8217; Compensation Penalties for Household Employers"},"content":{"rendered":"<p>If you employ a nanny or domestic employee, you may be required by law\u00a0to provide and maintain <a title=\"Workers\u2019 Compensation for Nannies\" href=\"\/household\/workers-compensation\/\" target=\"_blank\" rel=\"noopener\">Workers\u2019 Compensation<\/a> coverage, depending on your <a title=\"Workers\u2019 Compensation Requirements by State\" href=\"\/household\/resource-center\/workers-comp-requirements\/\" target=\"_blank\" rel=\"noopener\">state&#8217;s laws<\/a>. As the case study below shows, failure to comply could lead to extensive workers&#8217; compensation penalties.<\/p>\n<p><strong>The Situation<\/strong><\/p>\n<p>According to New York State law, any employer with employees working more than 40 hours per work week must provide workers\u2019 compensation insurance coverage. A household employer living in New York State paid a nanny to care for his children, but ignored the workers\u2019 compensation coverage requirement. In addition, to save herself from a long commute several times a day, the nanny stayed at the employer\u2019s house to rest, exercise, watch TV and do her own laundry when the children were at school or involved in activities away from home.<\/p>\n<p>According to New York State law, if an employee is on work premises, he or she is considered to be working. Therefore, not only was the household employer unsure as to the hours the nanny actually worked, he was also penalized $37,000 by the New York Workers\u2019 Compensation Board because the nanny was on premises throughout the day.<\/p>\n<p><strong>GTM\u2019s Solution<\/strong><\/p>\n<p>After immediately enrolling the household employer in a workers\u2019 compensation insurance policy, GTM\u2019s payroll and tax experts, along with the household employer, identified exactly when the nanny worked, specifically targeting when the nanny put in more than 40 hours a week. With this information, GTM then worked with the New York Workers\u2019 Compensation Board to reduce the fine.<\/p>\n<p><strong>The Results<\/strong><\/p>\n<p>GTM worked with the board to significantly decrease the household employer\u2019s penalty by knocking the compliance issue to only one year. During the year identified, GTM and the household employer showed that the nanny\u2014although on premises\u2014actually worked or was in the home 40 hours or more for only a small number of weeks during school breaks or when a child was home ill.
