You must have your nanny taxes ready before filing your personal tax return; some year-end forms are due by February 2, 2026.<\/p>\n<p>While tracking nanny tax withholdings with each pay period is much easier, you can \u201ccatch up\u201d at the end of the year. It will take a little more time and effort on your part. Here\u2019s how to catch up on your nanny taxes as you prepare your 2025 taxes (filing by April 15, 2026).<\/p>\n<h2>1. Verify if you have a household employee<\/h2>\n<p>Household employees are more than just nannies. Although in-home child caregivers are the most popular type of household workers, senior caregivers and companions, personal assistants, housekeepers, chefs, chauffeurs, estate managers, private educators, tutors, and others can be considered employees of your family.<\/p>\n<p>Recently, nanny shares \u2013 where two or more families hire a nanny for childcare in one of the family\u2019s homes \u2013 have become popular alternatives to daycare centers. Nannies working for families in a nanny share are also considered household employees.<\/p>\n<p>Seasonal or temporary employees, such as a summer or after-school nanny, can also be considered household workers.<\/p>\n<p>As long as that employee made at least $2,800 in 2025, you will have a nanny tax obligation (Social Security, Medicare, and potentially other responsibilities). Or if an employee made $1,000 in a calendar quarter, you will owe federal \u2013 and possibly state \u2013 unemployment taxes.<\/p>\n<p>You do not have to consider your spouse, a child under age 21, a parent, or any employee under 18 at any time in 2025 as a household employee for reporting Social Security and Medicare taxes.<\/p>\n<p>For federal unemployment taxes, do not count wages you paid to your spouse, a child under the age of 21, or a parent.<\/p>\n<h2>2. Obtain your tax identification numbers<\/h2>\n<p>If you have not already done so, you must obtain your federal employer identification number (FEIN) and state tax ID. <a href=\"https:\/\/www.irs.gov\/businesses\/small-businesses-self-employed\/apply-for-an-employer-identification-number-ein-online\" target=\"_blank\" rel=\"noopener\">Obtaining an FEIN is available online<\/a>. For your state,\u00a0<span style=\"box-sizing: border-box; margin: 0px; padding: 0px;\"><a href=\"https:\/\/www.irs.gov\/businesses\/small-businesses-self-employed\/state-government-websites\" target=\"_blank\" rel=\"noopener\">visit the state government website<\/a> and follow the steps to obtain<\/span>\u00a0your tax ID.<\/p>\n<h2>3. Calculate what your nanny earned each week<\/h2>\n<p>Under the <a href=\"https:\/\/www.dol.gov\/agencies\/whd\/flsa\" target=\"_blank\" rel=\"noopener\">Fair Labor Standards Act<\/a>, household employees must be paid by the hour and at least the prevailing <a href=\"https:\/\/gtm.com\/household\/learning-library\/minimum-wage-rates\/\">minimum wage rate for your state or locality<\/a>. They also receive time-and-a-half for hours worked over 40 in a workweek.<\/p>\n<p>It is vital to break down your employee\u2019s pay and hours worked by week to ensure they are paid at least minimum wage and compensated with overtime pay when applicable.<\/p>\n<h2>4. Establish your nanny tax obligation<\/h2>\n<p>You have two primary tax responsibilities when you have a household employee, like a nanny.<\/p>\n<p>There are Social Security and Medicare, commonly called FICA taxes. Both you and your employee contribute FICA taxes, which is 7.65 percent of gross wages (Social Security at 6.2 percent and Medicare at 1.45 percent). If you have not been remitting these taxes every quarter, you will owe the entire amount when you file your personal tax return. Your employee will also owe their share of FICA taxes when they file unless you pay them on their behalf.<\/p>\n<p>Then you have federal unemployment taxes (FUTA), six percent on the first $7,000 of gross wages. If you pay state unemployment taxes (SUI), you may be able to reduce your FUTA tax rate to 0.6 percent, cutting your obligation from $420 to $42. Once you are set up as an employer in your state, the state will provide your SUI rate.<\/p>\n<h2>5. Complete year-end nanny tax forms<\/h2>\n<p>Now we can get to the paperwork.<\/p>\n<p>First, you must provide your employee with <a href=\"https:\/\/www.irs.gov\/forms-pubs\/about-form-w-2\" target=\"_blank\" rel=\"noopener\">Form W-2<\/a> by February 2, 2026. These are usually due on January 31, which falls on a Saturday in 2026, so the deadline is pushed back to Monday. Before issuing their Form W-2, confirm your workers\u2019 legal name, address, and Social Security number. This will help reduce any errors when your employee files their return.<\/p>\n<p>If you decide to pay your employee\u2019s FICA taxes for them, this would be considered taxable income for income tax purposes on their Form W-2, but would not be subject to unemployment taxes or FICA.<\/p>\n<p><a href=\"https:\/\/gtm.com\/household\/learning-library\/independent-contractor-employee-classification\/\">Household workers are considered employees, not independent contractors<\/a>, so they <em>should not<\/em> receive a 1099 at tax time. In short, this is because you, as the employer, provide instructions to your employee, set their schedule, and provide the tools and equipment they need to do their job. Failing to classify your household worker correctly may constitute federal tax evasion because independent contractors are responsible for both the employer and employee shares of FICA taxes, and employers avoid unemployment taxes.<\/p>\n<p><a href=\"https:\/\/www.irs.gov\/forms-pubs\/about-form-w-3\" target=\"_blank\" rel=\"noopener\">Form W-3<\/a> and a copy of Form W-2 must be filed with the Social Security Administration by February 2, 2026.<\/p>\n<h2>6. File Schedule H with your personal tax return<\/h2>\n<p>When completing your personal tax return, <a href=\"https:\/\/gtm.com\/household\/do-i-need-to-file-schedule-h\/\">attach Schedule H (Household Employment Taxes)<\/a>. This is where you report your household employment taxes to the IRS.<\/p>\n<p>Before completing Schedule H, be prepared with this information:<\/p>\n<ul>\n<li>Your name, Social Security Number, and Employer Identification Number (EIN)<\/li>\n<li>Total wages paid to your household employees<\/li>\n<li>Federal income tax withheld<\/li>\n<li>State unemployment contributions<\/li>\n<\/ul>\n<p>If you are paying your entire nanny tax obligation when you file your personal tax return, you may owe too much in taxes and be hit with an underpayment penalty. Going forward, remit your nanny taxes quarterly using <a href=\"https:\/\/www.irs.gov\/forms-pubs\/about-form-1040-es\" target=\"_blank\" rel=\"noopener\">Form 1040-ES<\/a>.<\/p>\n<p>Your employer payroll taxes will typically fall between nine and 11 percent of your employee\u2019s gross wages.<\/p>\n<h2>7. Take the Child and Dependent Care Tax Credit<\/h2>\n<p>Household employers who pay their nanny legally can take advantage of the <a href=\"https:\/\/www.irs.gov\/taxtopics\/tc602\" target=\"_blank\" rel=\"noopener\">Child and Dependent Care Tax Credit<\/a> by filing <a href=\"https:\/\/www.irs.gov\/forms-pubs\/about-form-2441\" target=\"_blank\" rel=\"noopener\">Form 2441<\/a> with their personal tax returns. A nanny&#8217;s wages are considered a qualified expense. You can have up to $3,000 in expenses for one child or $6,000 for two or more children. Typically, you can claim 20% of your care expenses ($600 for one child or $1,200 for two or more children). Since this is a tax credit, you&#8217;ll directly reduce your taxes, dollar for dollar.<\/p>\n<h2>8. Take a deep breath<\/h2>\n<p>You got this! It is far better to do the work now to get caught up than to ignore your obligations and risk being caught for failing to pay your nanny taxes.
