You\u2019re an employer and they\u2019re your worker so there are laws to follow as with any type of employment. You have taxes to deduct, overtime to calculate, and a pay stub to issue.<\/p>\n<p>Yes, nannies and other household employees should get a pay stub every pay period even if they\u2019re being paid electronically (PayPal, Venmo, etc.) or by direct deposit.<\/p>\n<p>In fact, 41 states require that you provide an itemized pay stub to your employee (see chart below).\u00a0Even if it\u2019s not required in your state, it\u2019s highly recommended to provide a pay stub.<\/p>\n<p>This helps protects your employee from wage theft, which includes:<\/p>\n<ul>\n<li>Not being paid for all hours worked<\/li>\n<li>Not being paid at least time-and-a-half for overtime hours<\/li>\n<li>Improper or unauthorized deductions<\/li>\n<\/ul>\n<p>Providing a pay stub will also help answer any questions as to how you determined your employee\u2019s gross and net pay. They can feel confident they\u2019re being paid fairly for all hours worked and the correct deductions are being made.<\/p>\n<p>You may even want to keep weekly timesheets that shows when your employee started and ended work each day in a pay period, so everyone is on the same page as far as hours worked.<\/p>\n<p>Now that you know that you may need to (or should) provide a pay stub and the reasons behind it, let\u2019s look at what should be included on your nanny\u2019s pay stub.<\/p>\n<h2>Your nanny\u2019s pay stub<\/h2>\n<p>The items that should make up your nanny\u2019s pay stub include:<\/p>\n<ul>\n<li>Your name and address<\/li>\n<li>Employee\u2019s name<\/li>\n<li>Date of payment<\/li>\n<li>Pay period covered by payment<\/li>\n<li>Pay rate for regular and overtime hours<\/li>\n<li>Number of regular and overtime hours worked in the pay period<\/li>\n<li>Itemized list of deductions from wages, which typically include:\n<ul>\n<li>FICA taxes (Social Security and Medicare)<\/li>\n<li>Federal income tax<\/li>\n<li>State income tax (if applicable)<\/li>\n<li>Local income tax (if applicable)<\/li>\n<li>Other state deductions like disability insurance and\/or paid family leave if required<\/li>\n<li>Employee contributions to health insurance and\/or retirement plan<\/li>\n<li>Garnishments for unpaid income or property taxes and fines (you may be legally required to garnish an employee\u2019s paycheck if they owe money to the state or federal government)<\/li>\n<\/ul>\n<\/li>\n<li>Gross wages\n<ul>\n<li>Gross wages = (Regular hours x hourly rate) + (Overtime hours x time-and-a-half)<\/li>\n<\/ul>\n<\/li>\n<li>Net wages\/take-home pay (or amount of the pay check)\n<ul>\n<li>Employee\u2019s take-home pay = Gross wages \u2013 deductions<\/li>\n<\/ul>\n<\/li>\n<li>Year-to-date accruals of deductions<\/li>\n<li>Additions to wages, if any<\/li>\n<\/ul>\n<h2>Keeping records<\/h2>\n<p>Every time you pay your employee and provide a pay stub you should retain a copy for your records. This will save you a tremendous amount of time at the end of the year when you need to issue your employee their Form W-2, which details how much they earned and the taxes deducted so they can file their tax return. You\u2019ll also need their pay records to <a href=\"https:\/\/gtm.com\/household\/do-i-need-to-file-schedule-h\/\">complete Schedule H<\/a> and file your own taxes.<\/p>\n<p>Since nannies and other household employees are covered by the Fair Labor Standards Act (FLSA), the Department of Labor requires employers to keep certain records for their workers. These records must include certain identifying information about the employee and data about the hours worked and the wages earned.
