{"id":18135,"date":"2019-04-08T16:41:28","date_gmt":"2019-04-08T20:41:28","guid":{"rendered":"https:\/\/gtm.com\/household\/?p=18135"},"modified":"2020-02-27T09:53:41","modified_gmt":"2020-02-27T14:53:41","slug":"new-york-13-hour-rule","status":"publish","type":"post","link":"https:\/\/gtm.com\/household\/new-york-13-hour-rule\/","title":{"rendered":"New York Court of Appeals Upholds 13-Hour Rule for Home Health Aides"},"content":{"rendered":"<div id=\"attachment_18137\" style=\"width: 1034px\" class=\"wp-caption aligncenter\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-18137\" class=\"wp-image-18137 size-large\" src=\"https:\/\/gtm.com\/household\/wp-content\/uploads\/13-hour-rule-1024x683.jpg\" alt=\"13-hour-rule\" width=\"1024\" height=\"683\" srcset=\"https:\/\/gtm.com\/household\/wp-content\/uploads\/13-hour-rule-1024x683.jpg 1024w, https:\/\/gtm.com\/household\/wp-content\/uploads\/13-hour-rule-300x200.jpg 300w, https:\/\/gtm.com\/household\/wp-content\/uploads\/13-hour-rule-1080x720.jpg 1080w, https:\/\/gtm.com\/household\/wp-content\/uploads\/13-hour-rule.jpg 1920w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><p id=\"caption-attachment-18137\" class=\"wp-caption-text\">New York&#8217;s Highest Court has upheld the &#8220;13-hour rule&#8221; for household employees working 24-hour shifts.<\/p><\/div>\n<p>The <a href=\"https:\/\/www.nycourts.gov\/ctapps\/\" target=\"_blank\" rel=\"noopener noreferrer\">New York State Court of Appeals<\/a> has upheld the validity of the state\u2019s <a href=\"https:\/\/www.labor.ny.gov\/home\/\" target=\"_blank\" rel=\"noopener noreferrer\">Department of Labor<\/a> (DOL)\u2019s \u201c13-Hour Rule.\u201d<\/p>\n<p>A household employee who is asked to work a 24-hour shift will only need to be paid for 13 of those hours as long as the caregiver is provided with eight hours for sleep and three hours for meal breaks. These types of shifts can be common for senior caregivers providing around-the-clock care for a family\u2019s elderly loved one.<\/p>\n<p>If the employee\u2019s meal breaks are interrupted or if they do not get five uninterrupted hours of sleep, they must be paid for the entire break.<\/p>\n<p>Home health care aides in New York are covered by the state\u2019s Minimum Wage Order for Miscellaneous Industries and Occupations. This regulation states that an employee must be paid for the time they are \u201cpermitted to work or is required to be available to work at a place prescribed by the employer.\u201d However, the Wage Order also specifies that a household employee is not considered \u201cpermitted to work\u201d or \u201crequired to be available\u201d during the worker\u2019s normal sleeping hours even if they are required to be on call during this time and, therefore, can be unpaid for those hours. In addition, any time when the employee is free to leave the home can also be unpaid.<\/p>\n<p>In a March 2010 opinion letter, the DOL stated: \u201cit is the opinion and policy of this Department that live-in employees must be paid not less than for 13 hours per 24 hour period provided that they are afforded at least eight hours for sleep and actually receive five hours of uninterrupted sleep and that they are afforded three hours for meals.\u201d<\/p>\n<p>For purposes of interpreting the Wage Order, household employees that work 24-hour shifts are treated as \u201clive-in employees.\u201d<\/p>\n<p>Over the years, this interpretation of the Wage Order has been challenged in court. In this most recent case, the Court of Appeals \u2013 New York\u2019s highest court \u2013 looked at two appeals brought by home health aides. The plaintiffs sought to have employees paid for each hour of a 24-hour shift even if 11 hours were set aside for sleep and meal breaks.<\/p>\n<p>In a lower court ruling, the Appellate Division-Second Judicial Department ruled that the DOL\u2019s interpretation of the Wage Order was \u201cneither rational nor reasonable because it conflicts with the plain language of the Wage Order.\u201d The court noted that live-in employees were required to be present in their patients\u2019 homes and perform services as needed, and therefore needed to be \u201cavailable for work\u201d at all times, regardless of sleep or meal breaks.<\/p>\n<p>In its decision, the Court of Appeals held that the DOL\u2019s interpretation of the Wage Order does not conflict with the \u201cplain language\u201d of the Wage Order \u201cnor is it an irrational or unreasonable construction of the Wage Order\u201d as applied to home health aides working 24-hour shifts.
