Non-Immigrant<\/h2>\n<p>An immigrant is a foreign-born person who has the approval to reside permanently in the U.S. As a lawful permanent resident, they hold a Resident Alien Card, also known as a green card. Legal immigrants can be hired by any employer \u2013 including household employers \u2013 just like a U.S. citizen and without additional paperwork.<\/p>\n<p>A non-immigrant is an alien who seeks entry into the U.S. or who has already been admitted for a specific purpose for a temporary period of time, which can be a few days or several years. They must hold a visa to enter, stay, and work in the country. It is more difficult to hire a non-immigrant to work in your home.<\/p>\n<h2>Hiring a Non-Citizen Household Employee<\/h2>\n<p>Those people who are legally authorized to work in the U.S. include:<\/p>\n<ul>\n<li>U.S. citizens<\/li>\n<li>Legal permanent residents (including green card holders and immigrants)<\/li>\n<li>Other aliens authorized to work such as refugees, asylees, and persons in Temporary Protected Status<\/li>\n<\/ul>\n<p>All employers \u2013 including those who hire workers for their home \u2013 are responsible for verifying the identity and work authorization or eligibility of all individuals, whether U.S. citizens or not. This involves completing <a href=\"https:\/\/www.uscis.gov\/i-9\" target=\"_blank\" rel=\"noopener noreferrer\">Form I-9<\/a> for all employees. Your employee must produce proof of employment eligibility within three days after they begin work.<\/p>\n<p>Some documents that can be used to establish identification and employment eligibility include:<\/p>\n<ul>\n<li>U.S. passport<\/li>\n<li>Alien registration receipt card<\/li>\n<li>Permanent resident card<\/li>\n<li>Unexpired foreign passport containing an I-551 stamp<\/li>\n<li>Unexpired employment authorization document issued by UCSIS that contains a photograph<\/li>\n<\/ul>\n<p>Completing Form I-9 may protect you from liability even if your employee turns out to be unauthorized to work in the U.S. However, you should still use caution when reviewing and accepting an employee\u2019s documentation for Form I-9. The <a href=\"https:\/\/www.uscis.gov\" target=\"_blank\" rel=\"noopener noreferrer\">U.S. Citizenship and Immigration Services website<\/a>\u00a0(USCIS) and <a href=\"https:\/\/www.uscis.gov\/i-9-central\/handbook-employers-m-274\" target=\"_blank\" rel=\"noopener noreferrer\">Form M-274<\/a> can help ensure the validity of submitted documents.<\/p>\n<p>Largely for financial reasons, it may be attractive to hire non-citizens not legally authorized to work in the country. But doing so may be more costly in the end. If you\u2019re caught, you could face <a href=\"https:\/\/www.ice.gov\/factsheets\/i9-inspection\" target=\"_blank\" rel=\"noopener noreferrer\">thousands of dollars in fines<\/a> (even more for repeated offenses) and your worker may be deported back to their country of origin. It\u2019s also difficult to perform background checks on unauthorized workers, which puts your children\u2019s safety at risk.<\/p>\n<h2>Hiring a Foreign Household Employee<\/h2>\n<p>All other non-immigrant aliens must hold a visa authorizing them to work or be sponsored by a U.S. employer (like a family hiring a nanny).<\/p>\n<p>This can be a long and complex process. Before getting started, you may want to consult an immigration attorney to gauge your chances of success.<\/p>\n<p>The qualifying criteria for hiring a foreign household employee include:<\/p>\n<ul>\n<li>Must be hired as a full-time employee.<\/li>\n<li>Must have a bona fide job opening<\/li>\n<li>Can\u2019t tailor the job requirements to the foreign candidate\u2019s qualifications and must follow what is customarily required of the position in the U.S.<\/li>\n<li>Must pay at least the prevailing wage for the job in its location<\/li>\n<\/ul>\n<p>The following three classes of aliens are allowed to work in the U.S.:<\/p>\n<ul>\n<li>Authorized to work per their immigration status, such as green cardholders<\/li>\n<li>Permitted to work for a specific employer per their immigration and\/or visa status (this is the case for almost all non-immigrants that seek to work in the U.S.)<\/li>\n<li>Must first apply for and obtain permission from the USCIS to accept employment such as those enrolled in U.S. universities and are authorized to work in certain circumstances as part of their education)<\/li>\n<\/ul>\n<p>If you\u2019d like to hire an employee who is not legally authorized to work in the U.S., you\u2019ll need approval from several government agencies and take the following steps:<\/p>\n<ul>\n<li><a href=\"https:\/\/www.foreignlaborcert.doleta.gov\/perm.cfm\" target=\"_blank\" rel=\"noopener noreferrer\">File a labor certification<\/a> with the U.S. Department of Labor<\/li>\n<li>Complete a <a href=\"https:\/\/www.foreignlaborcert.doleta.gov\/form.cfm\" target=\"_blank\" rel=\"noopener noreferrer\">Form 9089<\/a> or <a href=\"https:\/\/www.foreignlaborcert.doleta.gov\/form.cfm\" target=\"_blank\" rel=\"noopener noreferrer\">Form 9142<\/a><\/li>\n<li>Petition the USCIS for a visa by submitting <a href=\"https:\/\/www.uscis.gov\/i-140\" target=\"_blank\" rel=\"noopener noreferrer\">Form I-140<\/a><\/li>\n<\/ul>\n<p>Once the foreign domestic worker is issued a visa number by the U.S. State Department, they are able to enter the U.S. However, they first must prove they are admissible to the country under the <a href=\"https:\/\/www.uscis.gov\/ilink\/docView\/SLB\/HTML\/SLB\/act.html\" target=\"_blank\" rel=\"noopener noreferrer\">Immigration and Nationality Act<\/a>.<\/p>\n<p>There are a couple of other avenues for foreigners to obtain a visa waiver or a work permit. However, these programs may not be suitable for foreign domestic workers hoping to be employed in the U.S.<\/p>\n<h3>Visa Waiver Program<\/h3>\n<p>Some foreigners are admitted into the country for 90 days through the Visa Waiver Program. However, they are not allowed to seek gainful employment while visiting the U.S. under this program.<\/p>\n<h3>Employment Authorization Document<\/h3>\n<p>A foreign worker could apply for an Employment Authorization Document (EAD), which is sometimes called a work permit. This allows an employee, regardless of citizenship or national origin, to be allowed to work in the U.S. This is different from a green card, which grants permanent residence.
