The following guide to marijuana laws by state describes what obligations (if any) employers have regarding legal medical or recreational marijuana use.<\/p>\n<p><strong>Please note that this is a rapidly changing area of law, and one where answers to many questions will not\u00a0<em>exist\u00a0<\/em>until a court case has been tried on the precise issue.\u00a0<\/strong>We will do our best to keep the information below current, but much of these laws is being made through the court systems, and not all court decisions are widely reported (or reported at all).<\/p>\n<p>If you are planning to take a hard line with an employee, particularly one whom you believe to use marijuana for medical purposes, it\u2019s best to consult with a human resources advisor or employment attorney who practices in your state.<\/p>\n<p>A few things to keep in mind about\u00a0<em><strong>all<\/strong><\/em>\u00a0marijuana laws:<\/p>\n<ol>\n<li>No employer needs to tolerate an employee using marijuana on the job.<\/li>\n<li>No employer needs to tolerate an employee being high on the job (as might result from smoking before work or during breaks).<\/li>\n<li>Where the information below says that medical use must be \u201caccommodated\u201d it means an employer will have to ignore the fact that someone uses marijuana off-duty for medical purposes, could use marijuana off-duty for medical purposes, or has a positive drug test result for THC. It\u00a0<em>does not<\/em>\u00a0mean they have to accommodate on-duty use or allow an employee to be high on the job.<\/li>\n<li>Except for Maine, no state has to accommodate recreational use, even off-duty.<\/li>\n<\/ol>\n<p>This list includes the types of marijuana use that are legal by state, and whether there are any explicit protections for employees related to use. For the purpose of this list, marijuana refers to a substance that includes THC and would result in a positive drug test.<\/p>\n<h3>Marijuana Laws by State<\/h3>\n<ul>\n<li><strong>Alaska:<\/strong>\u00a0Medical and recreational use. Employers have no obligation to accommodate medical use.<\/li>\n<li><strong>Alabama:<\/strong>\u00a0No legal use.<\/li>\n<li><strong>Arizona:<\/strong>\u00a0Medical use only. Employers must accommodate medical use unless they would lose federal funding or licensure, or for safety-sensitive positions.<\/li>\n<li><strong>Arkansas:<\/strong>\u00a0Medical use only.\u00a0Employers must accommodate medical use.<\/li>\n<li><strong>California:<\/strong>\u00a0Medical and recreational use.\u00a0Employers have no obligation to accommodate medical use.<\/li>\n<li><strong>Colorado:<\/strong>\u00a0Medical and recreational use. Employers have no obligation to accommodate medical use.<\/li>\n<li><strong>Connecticut:<\/strong> Medical use only. Employers must accommodate medical use unless testing is required by federal law or contract.<\/li>\n<li><strong>Delaware:\u00a0<\/strong>Medical use only.\u00a0Employers must accommodate medical use.<\/li>\n<li><strong>District of Columbia: <\/strong>Medical and recreational use.<\/li>\n<li><strong>Florida:<\/strong>\u00a0Medical use only. Employers have no obligation to accommodate medical use.<\/li>\n<li><strong>Georgia:\u00a0<\/strong>No legal use.<\/li>\n<li><strong>Hawaii:\u00a0<\/strong>Medical use only. Employers have no obligation to accommodate medical use.<\/li>\n<li><strong>Idaho:\u00a0<\/strong>No legal use<\/li>\n<li><strong>Illinois:\u00a0<\/strong>Medical use only.\u00a0Employers must accommodate medical use.<\/li>\n<li><strong>Indiana<\/strong>:\u00a0No legal use.<\/li>\n<li><strong>Iowa:\u00a0<\/strong>No legal use.<\/li>\n<li><strong>Kansas:<\/strong>\u00a0No legal use.<\/li>\n<li><strong>Kentucky:<\/strong>\u00a0No legal use.<\/li>\n<li><strong>Louisian<\/strong><strong>a:<\/strong>\u00a0Medical use only. Employers have no obligation to accommodate medical use.<\/li>\n<li><strong>Maine:<\/strong>\u00a0Medical and recreational. Employers must accommodate medical use. Additionally, Maine specifically protects\u00a0<em>recreational use<\/em>, meaning an employer may not discriminate or take any adverse action against an applicant or employee because of marijuana use or a positive drug test.<\/li>\n<li><strong>Maryland:\u00a0<\/strong>Medical use only. Employers have no obligation to accommodate medical use.<\/li>\n<li><strong>Massachusetts:\u00a0<\/strong>Medical and recreational. Employers must accommodate medical use unless they can show undue hardship.<\/li>\n<li><strong>Michigan:\u00a0<\/strong>Medical and recreational.<\/li>\n<li><strong>Minnesota:<\/strong>\u00a0Medical use only.\u00a0Employers must accommodate medical use.<\/li>\n<li><strong>Mississippi:<\/strong>\u00a0No legal use.<\/li>\n<li><strong>Missouri:<\/strong>\u00a0Medical use only. Employers have no obligation to accommodate medical use.<\/li>\n<li><strong>Montana:<\/strong>\u00a0Medical use only. Employers have no obligation to accommodate medical use.<\/li>\n<li><strong>Nebraska:\u00a0<\/strong>No legal use.<\/li>\n<li><strong>Nevada:<\/strong>\u00a0Medical and recreational. Employers have no obligation to accommodate medical use.<\/li>\n<li><strong>New Hampshire:<\/strong>\u00a0Medical use only. Employers have no obligation to accommodate medical use.<\/li>\n<li><strong>New Jersey:<\/strong>\u00a0Medical use only. Employers have no obligation to accommodate medical use.<\/li>\n<li><strong>New Mexico:\u00a0<\/strong>Medical use only. Employers have no obligation to accommodate medical use.<\/li>\n<li><strong>New York:<\/strong>\u00a0Medical use only. Employers must accommodate medical use unless they would lose a federal contract or funding, or it would cause an undue hardship.<\/li>\n<li><strong>North Carolina:\u00a0<\/strong>No legal use.<\/li>\n<li><strong>North Dakota:\u00a0<\/strong>Medical use only. Employers have no obligation to accommodate medical use.<\/li>\n<li><strong>Ohio:<\/strong>\u00a0Medical use only. Employers have no obligation to accommodate medical use.<\/li>\n<li><strong>Oklahoma:\u00a0<\/strong>Medical use only.<\/li>\n<li><strong>Oregon:\u00a0<\/strong>Medical and recreational use. Employers have no obligation to accommodate medical use.<\/li>\n<li><strong>Pennsylvania:<\/strong> Medical use only. Employers must accommodate medical use.<\/li>\n<li><strong>Rhode Island:<\/strong>\u00a0Medical use only. Employers have no obligation to accommodate medical use.<\/li>\n<li><strong>South Carolina:<\/strong>\u00a0No legal use.<\/li>\n<li><strong>South Dakota:<\/strong>\u00a0No legal use.<\/li>\n<li><strong>Tennessee:<\/strong>\u00a0No legal use.<\/li>\n<li><strong>Texas:<\/strong>\u00a0No legal use.<\/li>\n<li><strong>Utah:\u00a0<\/strong>Medical use only.
