{"id":6612,"date":"2019-04-15T09:41:12","date_gmt":"2019-04-15T13:41:12","guid":{"rendered":"https:\/\/gtm.com\/business\/?p=6612"},"modified":"2024-08-30T11:11:08","modified_gmt":"2024-08-30T15:11:08","slug":"new-york-voting-leave-law","status":"publish","type":"post","link":"https:\/\/gtm.com\/business\/new-york-voting-leave-law\/","title":{"rendered":"What is the Recent Change to New York&#8217;s Voting Leave Law?"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-6613\" src=\"https:\/\/gtm.com\/business\/wp-content\/uploads\/flag-1808671_1280.jpg\" alt=\"new york's voting leave law\" width=\"1280\" height=\"853\" srcset=\"https:\/\/gtm.com\/business\/wp-content\/uploads\/flag-1808671_1280.jpg 1280w, https:\/\/gtm.com\/business\/wp-content\/uploads\/flag-1808671_1280-300x200.jpg 300w, https:\/\/gtm.com\/business\/wp-content\/uploads\/flag-1808671_1280-1024x682.jpg 1024w, https:\/\/gtm.com\/business\/wp-content\/uploads\/flag-1808671_1280-1080x720.jpg 1080w\" sizes=\"(max-width: 1280px) 100vw, 1280px\" \/>Many states have voting leave laws, but it is also important to consider that many employers generally allow some\u00a0flexibility in hours when a national\u00a0or state\u00a0election is held even if voting leave is not required by law.<\/p>\n<p>Most of the state laws governing voting leave regulate:<\/p>\n<ul>\n<li>The amount of time permitted away from the workplace to vote;<\/li>\n<li>Whether wages may be deducted; and<\/li>\n<li>Which elections are subject to such regulations.<\/li>\n<\/ul>\n<h2>New York&#8217;s Voting Leave Law<\/h2>\n<p>As a result of a\u00a0<a title=\"new law\" href=\"https:\/\/nyassembly.gov\/leg\/?default_fld=&amp;leg_video=&amp;bn=S01505&amp;term=2019&amp;Text=Y\" target=\"_blank\" rel=\"noopener noreferrer\">new law<\/a> currently in effect, New York employers must:<\/p>\n<ul>\n<li>Pay for three hours of voting leave for any election. Unless an employer and employee otherwise agree, voting leave must be at the beginning or end of the work shift as designated by the employer.<\/li>\n<li>Post a\u00a0notice setting forth the state&#8217;s voting leave requirements\u00a0at least 10 working days before every election.<\/li>\n<\/ul>\n<p>In addition, employees must notify their employers of their need for time off to vote at least two working days before Election Day.<\/p>\n<p>Previously, employers only had to provide voting leave if their employees had insufficient time outside working hours to vote, and employers only had to pay for two hours of voting time. Additionally, employees previously had to notify their employers of their need for time off to vote at least two but not more than ten working days before Election Day.<\/p>\n<h2>Voting Leave Policies<\/h2>\n<p>If you distribute a voting leave policy to your employees, you should be sure that it is in line with your state voting leave law, if any.
