New York&#8217;s minimum wage schedule is segmented by region: New York City, some downstate counties, and the remainder of the state. There are also separate changes that affect the fast food industry.<\/p>\n<p><strong>New York City &#8211; 10 or More Employees<\/strong><\/p>\n<p>The minimum wage for businesses with 10 or more employees in New York City will be $11, with a $16.50 overtime rate. For businesses with tipped employees, the cash wage rate will be $7.50 with a $13 overtime rate. The tip credit\u00a0will be $3.50.<\/p>\n<p><strong>New York City &#8211; Under 10\u00a0Employees<\/strong><\/p>\n<p>The minimum wage for businesses with under 10 employees in New York City will be $10.50, with a $15.75 overtime rate. For businesses with tipped employees, the cash wage rate will be $7.50 with a $12.75 overtime rate. The tip credit\u00a0will be $3.00.<\/p>\n<p><strong>Nassau, Suffolk, and Westchester Counties<\/strong><\/p>\n<p>The minimum wage for businesses in these counties\u00a0will be $10.00, with a $15 overtime rate. For businesses with tipped employees, the cash wage rate will be $7.50 with a $12.50\u00a0overtime rate. The tip credit\u00a0will be $2.50.<\/p>\n<p><strong>Remainder of New York State<\/strong><\/p>\n<p>The minimum wage for businesses outside of New York City or Nassau, Suffolk, and Westchester counties\u00a0will be $9.70, with a $14.55 overtime rate. For businesses with tipped employees, the cash wage rate will be $7.50 with a $12.35 overtime rate. The tip credit\u00a0will be $2.20.<\/p>\n<p><strong>Fast Food Establishments<\/strong><\/p>\n<p>For those businesses falling under the <a href=\"https:\/\/labor.ny.gov\/workerprotection\/laborstandards\/pdfs\/FastFood-Wage-Order.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Fast Food Wage Order of 2015<\/a>, the minimum wage for those employees will increase to:<\/p>\n<ul>\n<li>$12 in New York City<\/li>\n<li>$10.75 in the rest of New York State<\/li>\n<\/ul>\n<p>Businesses must comply with these and all wage an hour laws.
