{"id":3956,"date":"2016-07-25T11:06:26","date_gmt":"2016-07-25T15:06:26","guid":{"rendered":"https:\/\/gtm.com\/business\/?p=3956"},"modified":"2024-08-30T11:15:32","modified_gmt":"2024-08-30T15:15:32","slug":"wage-theft-prevention-act-notices-re-classified-employees","status":"publish","type":"post","link":"https:\/\/gtm.com\/business\/wage-theft-prevention-act-notices-re-classified-employees\/","title":{"rendered":"Wage Theft Prevention Act Notices for Re-Classified Employees"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone wp-image-3957 size-large\" src=\"https:\/\/gtm.com\/business\/wp-content\/uploads\/money-case-163495_1280-1024x682.jpg\" alt=\"wage theft prevention act notices for re-classified employees\" width=\"1024\" height=\"682\" srcset=\"https:\/\/gtm.com\/business\/wp-content\/uploads\/money-case-163495_1280-1024x682.jpg 1024w, https:\/\/gtm.com\/business\/wp-content\/uploads\/money-case-163495_1280-300x200.jpg 300w, https:\/\/gtm.com\/business\/wp-content\/uploads\/money-case-163495_1280-1080x720.jpg 1080w, https:\/\/gtm.com\/business\/wp-content\/uploads\/money-case-163495_1280.jpg 1280w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/>With the upcoming implementation of the <a href=\"https:\/\/gtm.com\/business\/flsa-overtime-rule-announced\/\" target=\"_blank\" rel=\"noopener\">new FLSA overtime rules<\/a> on December 1st of 2016, many employers will be changing some employees&#8217; status from exempt to non-exempt to comply with the change in minimum salary threshold.<\/p>\n<p>Among other things to consider when changing an employees status is the requirement of <a href=\"https:\/\/labor.ny.gov\/workerprotection\/laborstandards\/employer\/wage-theft-prevention-act.shtm\" target=\"_blank\" rel=\"noopener\">New York&#8217;s Wage Theft Prevention Act<\/a>\u00a0which provides that all new hires receive a\u00a0notice detailing\u00a0their rate of pay (which also includes applicable overtime pay), the day of their regular payday, and\u00a0how their pay is calculated (by the hour, etc.). Any time an employee&#8217;s pay information is altered, a new notice must be provided to the employee reflecting the changes, which the employee must sign and return to the employer.
