What about part-time employees?<\/em><\/p>\n<p><strong>A:<\/strong>\u00a0Effective December 1, 2016, the <a href=\"https:\/\/gtm.com\/business\/flsa-overtime-rule-announced\/\" target=\"_blank\" rel=\"noopener noreferrer\">new rule<\/a> will apply to all employees who were previously exempt under the <a href=\"https:\/\/www.dol.gov\/whd\/overtime\/fs17a_overview.htm\">White Collar Exemptions<\/a> and subject to the minimum salary threshold.<\/p>\n<p>Certain white collar employees, such as some of those in sales, bona fide teachers, doctors, lawyers, and business owners, were not subject to the same (or any) minimum salary threshold previously, and that has not changed. All other employees classified under a White Collar Exemption must make at least $913 per week, or $47,476 per year, when the new rule goes into effect.<\/p>\n<p>The salary threshold will not fluctuate based on the number of hours worked, nor is there any pro-rating, so part-time and full-time employees will be subject to the same rule.<\/p>\n<p>As a reminder, to qualify as exempt, employees who meet the minimum salary threshold must also be paid on a salary basis \u2013 meaning their pay doesn\u2019t fluctuate based on number of hours worked or the quantity or quality of their work \u2013 and they must pass the <a href=\"https:\/\/www.dol.gov\/whd\/overtime\/fs17r_geico.htm\">duties test<\/a> for at least one of the FLSA\u2019s exemption categories.<\/p>\n<p>For more information and to learn how GTM keeps clients compliant with wage and labor laws, <a href=\"https:\/\/gtm.com\/business\/contact-gtm\/\" target=\"_blank\" rel=\"noopener noreferrer\">contact us<\/a> at (518) 373-4111.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The new FLSA overtime rules generally apply to all employees that will make over $47, 476 beginning December 1st, 2016.
