The new law, <strong>effective July 14, 2022<\/strong>, also provides free legal assistance to individuals who contact the hotline.<\/p>\n<h3>Employer Impact<\/h3>\n<p>The new law amends the state\u2019s existing Human Rights Law \u2013 which applies to all employers in the state, including household employers \u2013 to strengthen its current protections against workplace sexual harassment. Under the amendment, the Division must work with the New York State Department of Labor (NYDOL) to update \u201cany materials employers must post or provide to employees regarding sexual harassment\u201d so they include information about the new hotline.<\/p>\n<h3>Expected Updates<\/h3>\n<p>The current law requires employers to provide employees with a written\u00a0<a href=\"https:\/\/www.ny.gov\/combating-sexual-harassment-workplace\/employers\">workplace sexual harassment policy<\/a>\u00a0and annual\u00a0<a href=\"https:\/\/www.ny.gov\/combating-sexual-harassment-workplace\/employers\">training on workplace sexual harassment prevention<\/a>. In addition, the Division provides a model\u00a0<a href=\"https:\/\/www.ny.gov\/sites\/ny.gov\/files\/atoms\/files\/SexualHarassmentPreventionPoster.docx\">workplace poster<\/a>\u00a0on sexual harassment prevention as an optional tool for directing employees and others to an employer\u2019s sexual harassment prevention policy. Thus, employers may expect these and other materials to need updates starting July 14, 2022. All employers in the state should watch for more information from the Division and NYDOL.<\/p>\n<h3>Additional Hotline Details<\/h3>\n<p>The amendment requires the new hotline to operate during regular business hours. It also requires the Division to recruit attorneys with experience in providing counsel related to sexual harassment matters to provide free legal advice to hotline callers.<\/p>\n<p class=\"has-small-font-size\"><em>\u00a92022 Zywave, Inc.
